Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Mikhail Pak, an independent developer ("we", "our", or "us"), governing your use of the Lume mobile application and related features (collectively, "the app" or "Lume"). Lume is a personal finance tracking tool for iOS distributed through the Apple App Store.

By downloading, installing, or using Lume, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

Quick summary

1. Eligibility

You must be at least 13 years old to use Lume. If you are under the age of majority in your province, state, or country, you may use Lume only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the app, you represent that you meet these requirements.

2. License to Use the App

Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to download and use Lume for your personal, non‑commercial use on any Apple device that you own or control, as permitted by the Apple App Store Terms of Service and the Usage Rules in Apple's Licensed Application End User License Agreement. This license does not allow you to share, redistribute, or make the app available over a network where it could be used by multiple devices at once.

3. Your Data and Account

Lume does not require you to create an account. Your transactions, wallets, budgets, categories, and other content are stored on your device and, if iCloud is enabled, in your private iCloud account managed by Apple. You are responsible for:

4. Lume Pro and In‑App Purchases

Lume is currently free to download and use. Certain features may, now or in the future, be offered as part of Lume Pro, a premium tier sold as an auto‑renewing subscription through Apple's In‑App Purchase. If and when you purchase a subscription:

We may change which features are included in the free and paid tiers over time. We will not remove a feature that you have already paid for during your current paid term.

5. Voice and AI Features

Lume offers optional voice entry. When you use it, your speech is transcribed (via Apple's speech recognition) and the resulting text is processed by third‑party services (Cloudflare and Anthropic) to extract transaction details, as described in the Privacy Policy. AI‑generated results may be inaccurate or incomplete. You are responsible for reviewing and confirming any transaction details before relying on them. Do not use voice or AI features in a way that violates the third‑party providers' terms or applicable law.

It does not provide financial, investment, tax, accounting, or legal advice, and nothing in the app should be construed as a recommendation to take or refrain from any financial action. Calculations, summaries, insights, and projections are provided for your convenience only and may contain errors. You are solely responsible for your financial decisions and for verifying your own records. Consider consulting a qualified professional before making financial decisions.

8. Third‑Party Services

Lume relies on services provided by Apple, Cloudflare, and Anthropic to deliver certain features. Your use of those features may also be subject to those third parties' terms and policies. We are not responsible for the acts, omissions, availability, or content of third‑party services.

9. Intellectual Property

The app, including its software, design, branding, name, and logo, is owned by us and is protected by intellectual‑property laws. Except for the limited license granted above, these Terms do not transfer any rights, title, or interest in the app to you. The data and content you create remains yours.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the app is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non‑infringement. We do not warrant that the app will be uninterrupted, error‑free, secure, or that data will not be lost. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you, and you may have rights that cannot be excluded under applicable consumer protection law (including in Ontario).

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of (or inability to use) the app, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the app will not exceed the greater of (a) the amount you paid us (or to Apple for Lume) in the twelve (12) months before the claim arose, or (b) CAD $25.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including non‑waivable rights under Ontario consumer protection legislation.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and reasonable expenses arising out of your misuse of the app or your violation of these Terms or applicable law, to the extent permitted by law.

13. Apple App Store Terms

These Terms are between you and us only, not with Apple Inc. ("Apple"), and Apple is not responsible for the app or its content. You acknowledge that:

14. Changes to the App and These Terms

We may update, modify, or discontinue the app or any feature at any time. We may also revise these Terms from time to time; when we do, we will update the "Last updated" date above. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.

15. Termination

These Terms apply for as long as you use the app. You may stop using Lume at any time by deleting it. We may suspend or terminate your license if you materially breach these Terms. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict‑of‑law principles. You agree to the non‑exclusive jurisdiction of the courts located in Ontario for any dispute not subject to mandatory consumer‑protection venue rules.
